1. Introduction
Welcome to GoldenHourDesk ("we," "us," or "our"). These Terms & Conditions ("Terms") are a binding agreement for your usage of our yacht charter services and our website available at goldenhourdesk.site (the "Service"), which is managed by GoldenHourDesk.
By reserving a charter or utilizing our Service, you consent to be legally bound by these Terms. Should you not agree with any portion of these terms, access to the Service is not permitted for you.
2. Service Overview
GoldenHourDesk offers elite yacht charter services, which include but are not limited to:
- Daily yacht hire
- Sunset voyages
- Business getaways
- Exclusive events
- Prolonged charters
Service availability is contingent upon several factors including weather conditions. We retain the discretion to alter or cease services at any moment.
3. Booking and Reservations
3.1 Reservation Procedure
When making a charter reservation, the following criteria must be met:
- Attain at least 18 years of age
- Submit precise and complete data
- Remit the required upfront payment as delineated in your reservation confirmation
- Accept these Terms & Conditions
3.2 Charter Confirmation
Your reservation is deemed confirmed solely upon our receipt of your payment and issuing written confirmation. Service provision is subject to our sole discretion.
3.3 Charter Availability
Each charter depends on the availability of vessels and favorable weather conditions. Efforts will be made to accommodate your scheduling preferences.
4. Payment Terms
4.1 Charter Costs
Our costs, denominated in €, include all relevant taxes unless stated otherwise. These prices may alter without prior notice.
4.2 Installment Timeline
- Initial Payment: 50% of the total cost of the yacht charter required at the time of booking
- Outstanding Balance: Must be settled 48 hours before the set departure of the charter
- Incidental Fees (if applicable): Due at the termination of the charter
4.3 Payment Modes
We accept most major credit cards, electronic bank transfers, and certified cheques. All payment processing is conducted through secure, encrypted channels.
5. Cancellation and Reimbursement Policy
5.1 Cancellations by Client
- Beyond 72 hours prior to departure: Complete refund minus transaction fees
- Between 24 to 72 hours prior to departure: 50% refund
- Within 24 hours of departure: No refunds issued
5.2 Cancellations due to Weather
Should the weather circumstances be considered unsafe by our captain, we will propose to either:
- Reschedule the charter without additional costs to another available date
- Issue a full refund if an alternate date is not viable
5.3 Technical Difficulties
In the occurrence of mechanical faults with the designated vessel, we will strive to arrange an appropriate substitute. If no replacement is feasible, we will process a full reimbursement.
6. Safety and Conduct
6.1 Mandatory Safety Protocols
All guests are required to:
- Comply with all instructions from the crew
- Utilize safety equipment when indicated
- Declare any health conditions that might impact their secure participation
- Keep within specified areas aboard the vessel
6.2 Restrictions on Items
Passengers are not to bring the following items:
- Glass vessels
- Illegal materials
- Weapons or firearms
- Excessive amounts of alcoholic beverages (only moderate consumption is allowed)
- Pets (except with prior approval)
6.3 Guest Behavior
We expect passengers to behave respectfully. Charter services may be terminated prematurely, without refund, if passenger conduct endangers safety or diminishes the quality of experience for others.
7. Accountability and Insurance
7.1 Limitation of Liability
Any liability on our part is confined to the charter fee you have paid. We disclaim responsibility for:
- Personal harm resulting from the negligence of passengers
- Lost or damaged personal belongings
- Incidental, consequential, or punitive losses
- Delays prompted by adverse weather or events outside our influence
7.2 Insurance Coverage
Comprehensive marine insurance is in place, covering our fleet and operations. Guests bear responsibility for their travel and personal insurance.
7.3 Acceptance of Risk
Engaging in our maritime services signifies your acknowledgment of the intrinsic risks involved and your assumption of liability for your safety and health.
8. Adjustments and Itinerary Variations
We may alter routes, itineraries, or schedules due to weather, safety, or operational demands. Efforts will be taken to provide equivalent alternatives where possible.
9. Force Majeure
We shall not be responsible for interruptions, deferrals, or changes induced by factors beyond our control, such as but not restricted to:
- Extreme weather phenomena
- Acts of nature
- Statutory enactments
- Harbor shutdowns
- Technical malfunctions
10. Confidentiality and Information Security
Your private information will be managed as per our Privacy Policy. By employing our services, you consent to our collection and application of your information according to our Privacy Policy.
11. Proprietary Rights
All content on our webpage, which includes but is not limited to text, visuals, emblems, and snapshots, is safeguarded by copyright and trademark statutes. Unauthorized replication, circulation, or creation of derivative works is prohibited without our express consent.
12. Jurisdiction
The laws pertinent in Monaco govern these Terms. Any conflicts will be settled in the judicial courts of Monte Carlo, Monaco.
